A motion to form a class in a proposed action was held improper where class members failed to conform to Agency protocol in various ways. The class was ruled not to be sufficiently similar in compliance with Indiana Trial Rule 23, and therefore the subsequent class action was dismissed.
Jeremy D. Simpson v. State of Indiana
A defendant’s convictions for Class A Felony Voluntary Manslaughter, and Class D Felony Criminal Recklessness were upheld because the Court determined: 1) the State presented sufficient evidence of probative value to allow the jury to negate Defendant’s claim that he was legally justified in shooting the victim to defend a third person, 2)the trial court did not commit reversible error in denying Defendant’s request to recall a State’s witness, and 3) the trial court did not abuse its discretion in refusing Defendant’s jury instruction regarding the presumption of innocence and witness credibility.
